DELIVERY AND RETURNS
1. General Terms
1.1. These terms and conditions (hereinafter referred to as "Terms") govern the use of the online store www.popink.com(hereinafter referred to as the "Popink Store"). These Terms apply when the Popink Store's customer (hereinafter referred to as the "Customer") selects, orders, and purchases goods from the Popink Store or otherwise uses the services offered by the Popink Store.
1.2. The Popink Store is a retail e-commerce platform aimed at consumers purchasing products for personal, family, or household use, not related to business or professional activities.
1.3. The sale of goods in the Popink Store is organized and executed by POPINK, UAB (Company Code: 306701616; registered office: Lyglaukių g. 10B-2, Vilnius) (hereinafter referred to as the "Seller").
1.4. A "Customer" in these Terms refers to any person purchasing goods from the Popink Store or utilizing other services offered by the Popink Store. Only competent individuals, i.e., individuals who are of legal age (18 years or older) or emancipated individuals whose legal capacity has not been restricted by court order, and legal entities, represented by authorized representatives, are entitled to use the Popink Store and place orders. By registering or placing an order, the Customer confirms that they are legally entitled to purchase from the Popink Store.
1.5. Along with the Customer's order, these Terms become a binding legal agreement between the Customer and the Seller. The agreement is considered concluded when the Customer submits and pays for their order in the manner specified by these Terms.
1.6. The Customer is not allowed to place an order if they have not familiarized themselves with the Terms or do not agree to them. If the Customer does not agree with these Terms or any part of them, they should not place an order with the Popink Store. If the Customer places an order, it is considered that they have read and unconditionally agreed to these Terms. The Seller is not liable for any risks or liabilities arising from the Customer's failure to read the Terms, even though the opportunity was provided.
1.7. The Seller reserves the right to change these Terms. The updated Terms will apply only to new orders and will not affect previously placed orders. The Customer must familiarize themselves with the latest version of the Terms before placing a new order.
1.8. The Seller has the right to limit the Customer's use of the Popink Store services and/or terminate the Customer's registration if:
- The Customer seriously breaches these Terms, causing harm or risk to the Seller, other Customers, or third parties, or damaging the Seller's reputation or the stability and security of the Popink Store;
- The Customer repeatedly breaches these Terms after a warning; and/or
- The Customer does not remedy the breach within the period specified by the Seller after being notified.
1.9. The Seller has the right to temporarily or permanently suspend the operation of the Popink Store without prior notice to the Customer. In the case of force majeure events, the Seller has the right to suspend the fulfillment of the agreement until the force majeure situation ceases, notifying the Customer about the suspension. If the Customer no longer wishes to continue with the contract, they have the right to cancel it by notifying the Seller. In the event of such suspension, the Seller’s obligations for orders that have already been processed or are being processed will remain in effect as outlined in these Terms or applicable law.
2. Shipping Information
2.1. The Popink Store operates and delivers products within the territories specified on the Popink Store website, using the specified delivery methods and within the indicated timeframes. The shipping area is determined at the sole discretion of Popink. Products are delivered by the Seller or an authorized representative of the Seller.
2.2. A shipping fee is applied for product deliveries, which is indicated on the Popink Store website under the "Shipping Information" section and is applicable at the time of order submission. The shipping fee may be either fixed or based on the value of the products ordered and/or the delivery time selected.
2.3. When placing an order, the Customer agrees to provide an accurate delivery address for the products.
2.4. The products ordered by the Customer will be delivered to the address registered in the Popink Store system. The Customer agrees to personally accept the delivery. In cases where the Customer or recipient is not found at the delivery address provided in the Popink Store system, the Seller reserves the right to deliver the goods to any other capable person at the registered address, and the Customer may not raise any claims regarding the delivery to an incorrect recipient.
2.5. If delivery of the goods is impossible due to the Customer's fault or circumstances within the Customer's control (e.g., the Customer has provided an incorrect address in the Popink Store system, the recipient cannot be found at the given address, the person receiving the goods is a minor, the Customer provided an invalid identification document, or refused to provide an identification document when required by law or these Terms), the goods will not be re-shipped unless the Customer agrees to pay for a re-delivery. Any pre-paid amounts will be refunded minus the shipping costs.
2.6. In all cases, the Seller is not responsible for any delays in delivery or non-delivery of products if the failure to deliver or the delay is due to the Customer's fault or circumstances within the Customer's control.
2.7. In cases where the Customer notices a discrepancy in the goods upon delivery (e.g., the wrong quantity of items or items that do not match the order), the Customer must inform the Seller within a reasonable period of time after the delivery date. If the Customer finds that the delivered goods are of unacceptable quality, they have the right to submit a complaint regarding the product's quality within 2 years from the date of receipt (as per statutory warranty).

3. Product Exchange and Returns
3.1. The Customer has the right to withdraw from the purchase agreement made in the Popink Store by notifying the Seller in writing no later than 14 calendar days from the date of delivery of the product. The Customer must submit a withdrawal notice and other required information (product name, purchase confirmation document date, series, and number) to the Seller via email at info@popink.com, with the subject "Returning Products."
3.2. After submitting the written withdrawal notice and the required information as outlined above, the Customer must send or deliver the product back to the Seller (if delivered) no later than 14 calendar days in accordance with the product exchange and return procedure specified in Section 6.4 of these Terms. In this case, the Customer is responsible for the direct costs of returning the product.
3.3. In accordance with the Civil Code, the following quality products are non-returnable and non-exchangeable:
- Products made according to the specific instructions of the consumer that are not pre-made and are produced based on the consumer’s personal choice or specification, or products that are clearly tailored to the consumer’s personal needs;
- Perishable goods or goods with a short shelf life;
- Packaged goods that were unpacked after delivery and cannot be returned for health or hygiene reasons.
3.4. Quality products for which the Customer has withdrawn from the purchase agreement can be exchanged or returned in accordance with the provisions of the Civil Code. The Customer must contact the Seller at info@popink.com for returns or exchanges. When returning or exchanging products purchased in the Popink Store, the Seller has the right to request that the Customer complete the return or exchange form provided by the Seller.
3.5. Returned or exchanged quality products must be undamaged, with the original appearance intact (labels not removed or damaged, protective films not peeled off, etc.), with consumer qualities not altered, and cannot have been used. The product must be returned in its original packaging, with the same components as originally received by the Customer, and must include the purchase document and other product accessories. If the product is incomplete, damaged, untidy, or not properly packaged, the Seller has the right not to accept the product, refuse the exchange, and not return the amount paid by the Customer for the product.
3.6. Money paid for products accepted by the Customer but later withdrawn from the purchase agreement, including delivery costs, will be refunded to the Customer no later than 14 calendar days from the day the Seller receives the Customer’s withdrawal notice, unless otherwise agreed between the Seller and the Customer. When refunding the full amount paid by the Customer, the Seller must use the same payment method that the Customer used when making the payment, unless the Customer expressly agrees to a different method, provided the Customer does not incur any additional costs. The Seller may withhold the refund until the products are returned or until the Customer provides proof that the products have been sent back to the Seller, whichever occurs first.
3.7. Defective products must be returned to the Seller, and the money paid by the Customer for those products and their delivery will be refunded to the Customer according to the procedure specified in this section of the Terms.
3.8. The Seller has the right not to accept the products returned by the Customer if the Customer does not adhere to the return procedure set out in this section of the Terms.
4. Final Provisions
4.1. These Terms are drawn up in accordance with the legal acts of the Republic of Lithuania.
4.2. Lithuanian law shall apply to the relationships arising from these Terms.
4.3. In the event of damage, the at-fault party shall compensate the other party for both direct and indirect losses in accordance with the laws of the Republic of Lithuania.
4.4. Any disputes arising from the implementation of these Terms shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
4.5. Each Customer has the opportunity to resolve disputes with the Seller without going to court. The Customer must first contact the Seller in writing and, if no response is received or if the Seller’s response is unsatisfactory within 14 calendar days of the complaint/claim, the Customer may contact a non-judicial body responsible for resolving consumer disputes, namely the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, email: tarnyba@vvtat.lt, tel. 852626751, website: www.vvtat.lt), or its territorial subdivisions in the regions, or submit a complaint via the ODR platform at http://ec.europa.eu/odr/.
